The Terms of Service defines conditions for providing accommodation registration and conditions for providing e-mail service and rights and obligations between ABC Booking Pte Ltd and the Host.
Article 1 (Definition of words)
- "Host" - an individual or corporation who applied for this service.
- "ABC Booking" - our company
- "Accommodation intermediary site" - A service or site that matches the side that offers accommodation places to the accommodation applicant, such as Airbnb, Booking.com, HomeAway.
- "Property" - Room, building that the host registers with us.
- "This service" - the services we provide.
- "Service use agreement" - a use contract of this service to be concluded between this agreement and the Company and the host.
- "Intellectual Property Rights" - Includes copyright, patent right, utility model right, design right, trademark right and other intellectual property rights, or the right to apply for registration etc.
Article 2 (Service use contract)
1. When the host completes credit card settlement from our site, a service use contract with us will be signed. We may refuse to register the host according to our examination criteria. Reason for rejection is not disclosed.
2. The Company may refuse or cancel the registration if the applicant who falls under any of the following items falls under any of the following items, and we are not obligated to disclose any reason at all.

Article 3 (Change of Registered Items)
In the event that there is a change in the registered matter, the host must notify us of the change without delay by the method specified by the Company. In the event of damage to our company due to lack of host information provision, the host will compensate the whole amount.
Article 4 (contents of this service)
In this service, we will provide all or part of the business or functions specified below according to our plan selected by the host.
- Account registrations of accommodation intermediary sites and posting of property information
- Provide templates for property information, directions, house manuals
- Respond to e-mails to reservations and questions from guests
- Automatic message management
- Pricing
The above this service contents will be performed in accordance with ABC Booking rules. If Host wants to ask ABC Booking something other than ABC Booking rules, we will estimate the business cost. Some translation work uses machine translation. If Host want a human translation, Host will be charged separately.
We do not visit Host or Property and do not clean or repair Property and do not visit Property and bringing keys. These should be Host.
In some cases, we may carry out the business by assuming the name of Host when we perform the business in place of Host.
We do not guarantee yout profit and revenue. And cancellations of reservations occur on a daily basis. We are not responsible for any cancellation of reservations due to our responsibility.
Occasionally, a guest who has stayed refuses to pay. And he(she) do not accept credit card payments. Even if we protest, the media or credit card payment agency may not approve our protest. There are a certain number of malicious guests. In the end, you have no choice but to give up your bill. Let's think it the necessary expenses.
Article 5 (consideration of the service paid by the host)
As per the application form. Reservation service is required for reservations that have already been entered before the service start date, so it is subject to our service fee. We also reserve the right to be eligible for our service fees for future bookings in which we are involved after the service use date.
If Host requests us the non-regular work below, we will charge at least 5,000 yen for each action. However, the result of the action is not compensated.
Negotiation to get the cancel by guest. (Example: The accommodation facility wants to cancel a confirmed reservation for some reason, but asks us to negotiate with the guest in order to avoid the cost burden associated with the cancellation.)

Article 6 (Selling and receiving of property sales)
There are two ways of giving and receiving sales proceeds for the property. You may be transferred directly from the accommodation intermediary site to the host's bank account or transferred from our accommodation facility intermediary site to our bank account and from our company to the bank account of the host. If you receive sales proceeds via our company, we will transfer it from our company at the end of the month at the end of the month and overseas remittance fee will cost 4,000 yen and your bank comission per one time. If currency exchange occurs, it is calculated by the rate of that day or the average rate of that month. Transfer by paypal is 1500 yen.
In case of damage to the facilities by the guest or cancellation by the guest, please follow the management policy of the accommodation intermediary website or our regulations. Also, if these are not confirmed at the end of the month, the host will be charged temporarily.
As cancellation by the host, compensation for guests and compensation for alternative are all the responsibility of the host. If the payment is not finalized at the end of the month, the payment will be temporarily settled at the estimated amount determined by ABC Booking.
Fees paid for media (Airbnb, Booking.com etc.) will be deducted from sales according to the terms of each media. Credit card settlement fee (3.6%) is also deducted from sales.
If we need to dispatch a person to the accommodation in case of emergency such as loss of key, a minimum of 5,000 yen (excluding tax) + actual cost will be charged each time. This cost is borne by the Host. It is up to us to decide whether or not to be dispatched.
There is some obligation to pay, including the accommodation fee, between Host and ABC Booking, and the party delaying the payment immediately pays the other party a 15% annual interest as late damages.
Article 7 (Host obligations)
- The host should manage necessary and adequate management for the property owned by the Company in order to provide this service, and strive to maintain the facilities and supplies properly.
- The host must inform to ABC Booking in advance in case you change your posting content posted on the intermediary website of the accommodation yourself.
- The host naturally subscribes to insurance that compensates for damage, such as fire insurance for business, for the property.
- On the day when you can not lend the property, please inform to ABC Booking before making a reservation. If Host cannot provide the property after making a reservation, please note that Host must make reservation alternative property and pay this fee and compensate for ABC Booking fees. If Host can provide the property, but the same applies when you cancel the reservation or ask the guest to cancel it due to the convenience of Host.
- ABC Booking may ask Host to fill in the documents specified by ABC Booking to specify the details posted on the Accommodation intermediary site and guest correspondence. Host should fill in and reply promptly.
Article 8 (Prohibited matter)
In using this service, the host shall not perform any act that falls under any of the following items.
- acts in violation of these Terms or Regulations or acts related to crime
- Fraud or intimidation against our company, other users of this service or other third parties
- Acts contrary to public order and morals
- Acts that violate intellectual property rights, portrait rights, rights of privacy, honor, other rights or interests of the Company, other users of this service or other third parties
- An act of putting an excessive burden on the network or system etc of this service or an act of unlawfully accessing or attempting unauthorized access to our network or system etc
- Spoil acts as a third party
- Collection of information on other users of this service
- Provide benefits to antisocial forces
- Other acts that we deem inappropriate
Article 9 (suspension of this service etc.)
We shall be able to suspend or suspend the provision of all or part of this service without notifying the host in advance if it falls under any of the following.
- In case of urgent inspection or maintenance work of the computer system related to this service
- When computer, communication line, etc. cease due to accident
- When the service can not be operated due to force majeure such as earthquake, lightning strike, fire, wind and flood damage, power failure, natural disasters
- If the Company determines that the host violates this agreement or there is a possibility of it

- The Company shall not take any responsibility for damage caused to the host by measures taken by the Company under this section.
Article 10 (Rights attribution etc)
1. All intellectual property rights relating to this service are attributed to us or those who license the company to us, and licensing of this service based on this agreement is licensed to us or our company concerning this service It does not mean the license of the intellectual property right of the person who is doing.
2. With respect to intellectual property rights belonging to the host among the data on photographs and the like relating to the property of the host, the host shall notify the Company of the world, nonexclusive, free of charge, sublicensable and assignable usable, Distribution, grant a license concerning creation, display and execution of derivative work.
3. The host agrees not to exercise the moral rights of the author for the person succeeded or granted the rights from us and the Company.
Article 11 (Termination of contract by us etc.)
1. If the host falls under any of the following reasons, the Company shall delete the posting data or temporarily suspend the use of the service concerning the host without notice or demand in advance , Or cancel the contract of this service.

Article 12 (withdrawal)
1. To withdraw from the membership, The Host need to submit a document such as a cancellation notice to ABC Booking. If it is predicted that the withdrawal will be announced orally before the withdrawal is confirmed, the acceptance of new reservations will be suspended, the rental contract of the property concerned will be canceled or the ownership will be transferred, ABC Booking will immediately settle the money at our discretion. 2. If The Host cancel due to The Host's convenience, please be aware that the handling of reserved guests, the policies and rules of the booking site, and the policies and rules of ABC Booking are involved. 3. The Host will withdraw from This service after the elapsed date stated in the application form by sending a document requesting cancellation by fax or mail (name, contact information, property name / address / room number, desired cancellation date) to ABC Booking. ABC Booking will transfer or settle the ABC Booking fee for reservations that have already been confirmed after the cancellation date to the designated account of ABC Booking by the day before the cancellation date. In the unlikely event that The Host cancel without permission, The Host will be required to pay the appropriate fee and the cost associated with the cancellation (such as the accommodation fee of the alternative property to the guest) to ABC Booking immediately. In addition, if The Host stop accepting new reservations without withdrawing from the membership, the same ABC Booking rules as withdrawal will apply.
4. If there is any debt owed to ABC Booking upon withdrawal, The Host will discuss the debt owed to ABC Booking, ABC Booking's future profits, and risks such as penalties that may occur in the future. The Host must immediately pay all debt to ABC Booking.
5. Accommodation user information after withdrawal (information related to identification of accommodation users of this service including The Host, activity history on communication services, other terminals such as smartphones, PCs, etc. of the accommodation user or the accommodation Information generated or accumulated in connection with the user's terminal, which is collected by ABC Booking based on ABC Booking's privacy policy), shall be handled in accordance with ABC Booking's regulations.
6. The Host must respond in good faith to all bookings already confirmed at the end of this Service use agreement. For example, make an effort to get the reservation person to approve the cancellation of the reservation, or The Host will pay for the alternative Property. If The Host entrust this to ABC Booking, The Host will have to pay a considerable amount (or estimated amount) to ABC Booking until the cancellation date.
7. If The Host agrees to reuse listings, directions, house manuals, photos, etc. created by ABC Booking, it will be transferred for 300 US$ per data or 1,000 US$ per listing as related data of the entire listing. The Host can do it. If The Host want to advance the contract end date due to The Host's convenience, The Host can advance the contract end date for 1,000 US$ per listing.
8. If The Host cancel The Hostr accommodation reservation due to The Host's circumstances, The Host will be required to pay the cancellation fee and ABC Booking fee regardless of the timing of withdrawal.
9. The Host is obliged to continue accepting accommodation reservations within 30 days from the date when the cancellation notice is received by ABC Booking. If the Host does not accept reservations for more than 3 days during this period, you will be charged US $ 100 as a special treatment fee.
Article 13 (re-entrusted)
The Company shall be able to re-entrust the whole or a part of the work related to this service to a third party at its own risk.
Article 14 (Change and termination of contents of this service)
1. The Company may change the contents of this service or terminate the provision for the convenience of our company. We will notify the host in advance if we terminate the provision of this service or change the important part.
2. The Company shall not be held liable for any damages caused to the host based on the measures taken by the Company under this section.
Article 15 (possibility of our failure or error)
The host preliminarily acknowledges that the Company may possibly cause the reasons specified in the following items.
- Misdirected transmission or incompleteness occurs in connection with guests or cleaning companies or hosts.
- Failure of all or part of the work due to accident or defect of the system of the accommodation intermediation site occurs.
- Host evaluation and credit, etc. at the accommodation intermediary site will decrease.
- The information posted on the brokerage website of the accommodation is not specified by the host.
Article 16 (Disclaimer)
The host studies in advance what kinds of problems arise due to the operation of the accommodation facility, and in advance we will accept no responsibility even if the events specified in the following items occur.
- In cases where the Company can not provide this service due to termination or suspension of the service regardless of reasons attributable to our company's brokerage site such as violation of laws and regulations

- If the cleaning work is delayed or impossible due to staying guests or guests even after a predetermined time has elapsed
- Credit card company's chargeback occurs for the amount the host should receive from the accommodation intermediary site
- When aging deterioration, deterioration of quality, problems occur in the property
- In the event of a criminal act such as theft, damage to property or injury in the property
- We will not be liable to compensate for the damage on the lost profit of the host.
- We do not assume any responsibility for transactions, communications, disputes, etc. arising between the host and guest or third party in connection with this service.
As mentioned above, we will not compensate for any damages to the accommodation facility, even if it is our responsibility. However, if we recognize that we are responsible for compensation, the maximum amount of compensation will be up to one month's our service fee from the accommodation that we received the month before the damage occurred.
Article 17 (Confidentiality)
The host shall treat confidentially the unknown information disclosed by the Company to the host in connection with the Service unless we have prior written consent of the Company.
Article 18 (Handling of Guest Information)
1. The handling of guest accommodation user information by the Company and the host shall be made separately according to our privacy policy, and the host agrees that we will handle the accommodation user information of the host in accordance with this privacy policy.
2. The Company shall be able to use and disclose the information, data, etc. that the host has offered to the Company as statistical information in a form that can not identify individuals at our discretion and the host objections thereto I will not cast them.

Article 23 (Governing Law and Jurisdictional Court)

2. For any disputes arising out of or related to these Terms or Service Contracts, the Tokyo District Court shall be the first examiner's exclusive jurisdiction court.
